Terms of Service

By accessing or using the BlueNest platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

BlueNest provides AI-powered real estate property analysis tools, including but not limited to comparative market analysis (CMA), property valuation estimates, market insights, and related services. Our analysis tools are designed to assist real estate professionals, investors, buyers, and sellers with data-driven property insights.

The information provided through the Service is for informational purposes only and should not be considered professional real estate appraisal, financial advice, or legal counsel. Users should consult qualified professionals for decisions involving property transactions.

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

You must provide accurate and complete information when creating your account and keep your account information up to date. You may not use another person’s account without their permission.

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

All fees are non-refundable except as required by law or as expressly stated in these Terms. We reserve the right to change our pricing with reasonable notice.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Interfere with the proper functioning of the Service
• Redistribute, sublicense, or resell access to the Service without authorization
• Use the Service to generate misleading or fraudulent property valuations
• Misrepresent BlueNest analyses as certified appraisals

BlueNest uses MLS data, public records, and AI models to generate property analyses. While we strive for accuracy, we do not guarantee the completeness, reliability, or accuracy of any information provided through the Service. Property valuations are estimates and may differ from actual market values or professional appraisals.

Real estate markets are dynamic and subject to rapid changes. Past performance and historical data do not guarantee future results. Users should independently verify all information before making financial decisions.

The Service, including its design, features, content, and underlying technology, is owned by BlueNest and protected by intellectual property laws. You retain ownership of data you provide to the Service. By using the Service, you grant BlueNest a limited license to process your data to provide the Service.

To the maximum extent permitted by law, BlueNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

In no event shall BlueNest’s total liability exceed the amount you have paid to BlueNest in the twelve months preceding the claim.

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may terminate your account at any time through your account settings.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
